Le juge du tribunal des flagrants délits de Dakar a condamné, hier, Aliou Seck, Mame Diarra Diop et Mor Mbengue à une peine d’emprisonnement de 2 ans dont 1 mois ferme, chacun. Ils ont été déclarés respectivement, coupables des délits de vol en réunion et de complicité de ce chef et de proxénétisme.
Ils sont au nombre de cinq (5) prévenus dont 4 élèves âgés entre 18 et 19 ans à comparaître, hier, à la barre des flagrants délits de Dakar. Si les lycéens sont poursuivis pour des faits de défaut de carnet sanitaire ou de vol en réunion, Mor Mbengue, lui, répondait de complicité de ce chef et de proxénétisme. Ils sont traduits en justice par le nommé Belel Diallo. Ce dernier leur reproche de l’avoir drogué avant de soustraire ses 600.000 francs et son téléphone de marque IPhone 12 Pro Max. Ce, avec la complicité de Mor Mbengue qui lui a loué une chambre avant de donner des informations sur lui à ses coprévenus qui sont venus le déplumer.
Des faits que le mis en cause Mor Mbengue a battus en brèche. Marié et père de deux enfants, Mor Mbengue fait savoir que ce n’est pas la première fois qu’il loue ses appartements à la partie civile. Car, explique-t-il, à chaque fois que celui-ci quitte la Mauritanie pour venir au Sénégal, il le contacte afin qu’il lui loue un appartement. «Quand Belel Diallo m’a contacté je lui ai fait savoir que mes appartements ne sont pas disponibles. Je l’ai mis en rapport avec un ami qui lui a loué un appartement. J’ai reçu une commission de 5000 francs. Après les faits, Belel a rappliqué chez moi pour m’informer de sa mésaventure». À l’en croire, Il avait indexé Fatima Fall qui est en cavale.
Ce qu’a conforté exactement Aliou Seck, prévenu de vol en réunion. Pour cet élève de seconde, c’est Fatima Fall qui a volé l’argent. «J’étais devant le taxi. Fatima Fall et Mame Diarra Diop étaient derrière. On avait quitté Maristes pour se rendre à Ouest-Foire afin de trouver un appartement. C’est quand on est descendu du taxi que le plaignant nous a accusé de vol. Je détenais 10.000 francs au lieu de 100.000 francs», se dédouane-t-il.
Née en 2003, Fatoumata Aw, poursuivi, en sus du vol de défaut de carnet sanitaire, a reconnu devant le juge avoir drogué le plaignant. Elle avait déclaré même à la police avoir reçu 150.000 francs du butin. Quant à sa coprévenue, Mame Diarra Seck, élève en première S2, elle a nié les faits qui lui sont reprochés. Même si elle reconnaît connaître Fatoumata Aw, elle soutient ne pas être sur les lieux au moment des faits.
La jeune fille Mame Diarra Diop, elle, avait confié à la police que c’est bien Mor Mbengue qui leur a dit que la victime détenait de l’argent avant de les instruire de le dépouiller. Selon elle, ils ont par la suite donné l’argent à Aliou Seck qui a procédé au partage. Elle avait déclaré avoir acheté un iPhone à 120.000 francs après avoir reçu 150.000 francs. Hier, à la barre, elle fait savoir que c’est Fatima Fall, la copine de la partie civile, qui a pris l’argent. «C’est elle qui nous a demandé de l’accompagner à Ouest-Foire afin de trouver un appartement».
Selon Me Takha Cissé, conseil de la partie civile, c’est Mor Mbengue le commanditaire de cette affaire. «Mon client n’a pas pu venir pour des raisons professionnelles. Il a l’habitude de louer une chambre à la Cité Mixta pour des raisons professionnelles. C’était dans la nuit du 29 au 30 qu’elle a eu une visite d’une fille du nom de Fatima Sow qui lui a administré une substance qui l’a plongé dans un sommeil profond». De l’avis de la robe noire, c’est Mor Mbengue qui utilise des filles en leur donnant des informations sur le patrimoine de ses locataires. «Des sommes ont été retrouvées. Aliou détenait 100.000 francs», soutient l’avocat qui réclame la somme de 2.000.000 de francs pour le compte de son client.
À la suite du représentant du ministère public qui a requis l’application de la loi, les conseils de la défense ont sollicité la clémence du tribunal. Ce dernier, après délibéré, a relaxé Fatoumata Aw et Mame Diarra Seck de tous les chefs. Quant à Mor Mbengue, Aliou Seck et Mame Diarra Diop, ils ont été déclarés coupables avant d’être condamné à une peine d’emprisonnement de 2 ans dont 1 mois ferme. Ils sont aussi condamnés à payer solidairement la somme de 1.500.000 francs à la partie civile.
